Social Security Policies Take Effect in September 2018

Supporting people with meritorious services to the revolution residing overseas; amending general conditions for granting construction practice certificates to labourers; imposing 15 standards to qualified teachers; and at least nine decrees on wages to be issued till 2021 are remarkable social security policies effective from September 1, 2018.

Supporting people with meritorious services to the revolution residing overseas
Effective on September 5, 2018, Decree 102/2018/ND-CP dated July 20, 2018 of the Government governs support and some other remuneration regimes for Vietnamese people having meritorious services to the revolution, joining the resistance war to defend the fatherland and performing international duties living abroad. People faring resistance wars against France and America living in foreign countries are entitled to get VND4 million of allowance for two years of service downwards and an increment of VND1.5 million for each year of service from the third year of service onwards. In case of death before September 5, 2018, relatives are entitled to a one-time allowance of VND6 million. Besides, if they return to Vietnam to settle down, they will be entitled to health insurance applied to people with meritorious service to the revolution and veterans. Upon death, they will get funeral allowances according to the current social insurance law.

Using funds for the Climate Change and Green Growth Programme 2016-2020
The Ministry of Finance's Circular 70/2018/TT-BTC, effective from September 22, 2018, regulates management and use of non-productive funds for the implementation of the Climate Change and Green Growth Programme. The “Green Growth” component will use funds for training to raise the capacity of workers, collect input data, train and communicate the private sector and commercial banks. The spending value is governed by the current law.

Five standards required for a school principal
Circular 14/2018/TT-BGDDT dated July 20, 2018 of the Ministry of Education and Training, effective from September 4, 2018, stipulates standards of a school principal. Accordingly, the head of a school must satisfy five criteria: Ethics; school administration; educational environment construction; school-family-society relationship development; and foreign language and information technology. The principal will assess himself/herself according to these standards and the school will consult its teachers and employees on current standards of the school headmaster. The head of the administrative unit that administers the school shall evaluate and notify principal standard assessment result, based on self-assessment, consultations on teachers and employees, and actual performance of the headmaster. The headmaster performs self-assessment once a year at the end of the school year. And, the education authority conducts the headmaster assessment one time each two years. In case of speciality, this time may be shortened.

Changing general conditions to obtain construction practice certificates
The Government’s Decree 100/2018/ND-CP, effective from September 15, 2018, amends, supplements and abolishes a number of provisions on business and investment conditions administered by the Ministry of Construction. The decree amends and supplements regulations on common conditions for the granting of construction practice certificates as prescribed in Decree 59/2015/ND-CP of the Government dated June 18, 2015 on management of construction investment projects. Labourers will be granted practice certificates when they satisfy conditions such as having full civil act capacity as provided for by law; having a residence permit or a work permit in Vietnam for foreigners and Vietnamese residing abroad; having professional qualifications, training time and experience in accordance with contents of application for practice certificates; satisfying requirements of professional experience and legal knowledge related to the field of practice.

‘Standard’ secondary teacher must meet 15 norms
On August 22, 2018, the Ministry of Education and Training issued Circular 20/2018/TT-BGDDT on regulations on professional standards of a secondary teacher. Accordingly, the standard of a secondary teacher consists of five criteria and 15 norms such as teacher virtue; professional development; educational environment construction; school-family-society relationship development; foreign language ​​or ethnic languages, information technology application and ICT device use. The standards of foreign language use is rated: Pass level (Simple communications in foreign languages or second language); Good level (communicate information on simple topics or daily topics relating to education); and Excellent level (write or present paragraphs on simple, familiar topics relating to teaching, education, etc.) The teacher performs self-assessment once a year at the end of the school year. And, the headmaster who manages them conducts the teacher assessment one time two years.

At least nine decrees on wages to be issued from now to 2021
To carry out salary reforms for public employees, officers of armed forces and corporate labourers, the Government will issue many decrees on wage in the coming time. According to Resolution 107/NQ-CP of the Government dated August 16, 2018, decrees on wage to be issued from now to 2021 include: Decree on salary adjustment applicable to public employees, officers of armed forces pursuant to Resolution 25/2016/QH14; Decree on new salary regime for public employees, officers of armed forces in place of Decree 204/2004/ND-CP; Decree on pilot management of labour management, salary and bonus for labourers and managers of some economic groups and corporations; Decree detailing the Labour Code on establishment and operation of labourer representative organisations; Decree on management of labour, salary and bonus for labourers (including executive boards) in State-owned enterprises; Decree on management of salary and bonus for persons representative of State ownership in State-owned enterprises; Decree on determination of wage costs in unit price of public-utility products and services; Decree on management of labour, salary and bonus for labourers (including executive boards of enterprises) based on job performance; and Decree on salary and bonus for Board members and supervisors (from profit after tax).
