Cases enjoyed investment incentive from the Investment Law
Please let us about the cases enjoyed investment incentive in accordance with Decree No.108/2006/ND-CP of the Government detailing and guiding the implementation of some Articles of Law on Investment?
On 13 March 2007, General Department of Customs issued Official Letter No. 1486/TCHQ-GSQL (the “Official Letter”) guiding the cases enjoyed investment incentive in accordance with Decree No.108/2006/ND-CP of the Government detailing and guiding the implementation of some Articles of Law on Investment.
According to this Official Letter, with respect to enterprises (located in industrial zones which have not approved on establishment by the Prime Minister) which are operating under investment licenses which issued before the Law on Investment come into effect and be considered for enjoying tax exemption due to their business activities in accordance with investment incentive scope and business activities as regulated in Appendix I, Decree 149/2005/ND-CP of the Government, shall carry on being enjoyed investment incentives in accordance with such investment licenses with respect of equipments, devices, machineries imported for purpose of creating fixed assets. With respect to enterprises which were granted Investment Licenses in accordance with Law on Investment, investment incentives shall comply with regulations of Decree No.108/2006/ND-CP of the Government as mentioned above.
