Vietnam’s Producers of Frozen Pangasius Fillets Protest against U.S Antidumping Duties
Vietnam Pangasius Association which represents for Vietnam’s pangasius farmers, producers and exporters, recently released a proclamation to protest against the final result made by the Department of Commerce (DOC) of the United States on March 31, 2014 of the ninth antidumping duty administrative reviews on Vietnam’s frozen pangasius fillets imported to U.S with the period review from August 1, 2011 to July 31, 2012.
Accordingly, the antidumping duties on products of the two mandatory respondents of Vinh Hoan Corporation and Hung Vuong Corporation is US$0.03 and US$1.2 per kilogram, respectively. The remaining separate rate respondents are US$0.42 per kilogram and Vietnam-wide rate is US$2.11 per kilogram.
“The final results of the ninth administrative review on Vietnam’s frozen pangasius fillets exported to U.S market has been reduced in comparison with the preliminary decision issued last September but it still raises difficulties for Vietnam enterprises. Vietnam’s frozen pangasius products have been beard higher and higher antidumping tax rates from many years. This significantly effects on people who work in Vietnam’s pangasius industry from exporters, producers to farmers. It also effects on American consumers and goes against general cooperation trend between Vietnam Government and US Government,” stated Vietnam Pangasius Association in a press release.
“U.S Department of Commerce selects Indonesia to be the primary surrogate country for its calculations of the weighted-average dumping margins and antidumping tax rates because Vietnam is considered a non-market economy, not economically comparable. Indonesia has GNI and GDP higher than Vietnam and does not have similarities breeding standards and input cost with Vietnam. Therefore, choosing Indonesia to measure antidumping tax has made Vietnam endure high tax rates which affect the whole Vietnam’s aquaculture industry.”
Vietnam Pangasius Association suggests US Department of Commerce (DOC), US Antidumping Investigation Commission and the US Congress to reconsider the antidumping duty rates in the next administrative review (POR 10) on frozen pangasius products traded in the U.S market and choose Bangladesh as surrogate country to count dumping margin and antidumping tax rates instead of Indonesia.
