Breakthrough in Land Clearance Work

In recent years, Hanoi has effectively implemented the policy of the Party and the State on land clearance work when the State reclaims land for investment projects in the area, contributing importantly to local socio-economic development. The majority of the people whose land was reclaimed agreed with the policies of the Party and State, helping land clearance work go smoothly. Finding out more about this issue, Vietnam Business Forum had an interview with Mr Truong Quang Thieu, Head of the Steering Committee of Hanoi City, on land clearance work. Trang Tran reports.
 
Can you please tell us some outstanding results and typical projects in Hanoi land clearance work in recent years?
Based on Resolution 20-NQ/TU dated 13thJuly 2000 of the 17th Session of the Executive Committee of the City on land clearance work when the State reclaims land for socio-economic development and Resolution 09/2000-NQ/HD dated 2nd July 2000 of the People's Council on land clearance work in the area of Hanoi, the City People's Committee issued Decision 88-QD/UB dated 31st October 2000 establishing the Steering Committee of Hanoi City as a specialised agency to help the city direct all clearance work of Hanoi.
 
Working drastically in land clearance work, arranging resettlement, and making a breakthrough in construction are requirements by Chairman Nguyen The Thao of Hanoi People’s Committee for departments and localities. At this time, the requests of the Chairman Nguyen The Thao are being performed seriously with obvious changes. The changes can be seen very clearly in the beginning area of Nhat Tan Ring Road 2 - Cau Giay, the segment connecting to Nhat Tan bridge. After receiving 100 percent of ground, construction units have completed about 97 percent of the workload and expect to complete this entire package within the next few days. Thus, when Nhat Tan bridge is completed and put into use, the road from Nhat Tan bridge to Xuan La with the length of 1.8 km will be open for traffic.
 
To further promote the efficiency of the project, the next packages of Ring Road 2 project are also speeding up. Construction package from Xuan La to Buoi with nearly 1.6 km length has been under construction since November 2012 and about 35 percent of the work has been done. The biggest obstacle for site clearance work is now to determine the origin of land. Due to urbanisation or complicated local land management, it takes great time to identify agricultural land to ensure the rights of the people whose land is reclaimed. However, local governments are determined and committed to completing site clearance in accordance with requirements of the City People's Committee.
 
What are the main measures to complete the site clearance task in 2014 and the following years?
In 2014, the Hanoi People's Committee decided to offer VND700 billion from the reserved financial fund of the city to create capital for site clearance for key projects which will be completed in 2014-2015.
 
Hanoi city has also issued Decision 02 on compensation rates for institutions and individuals having acquired land to construct public projects. Accordingly, the compensation will not apply directly the bracket issued annually by the city People’s Committee but through independent consulting unit in order to provide compensation rates close to market value. Currently, the city People's Committee is assigning the Department of Finance as an agency with the task of guiding the People’s Committee with the process and procedures for hiring consultants to redefine the price of land as the base for compensation. Therefore, projects implementing under the previous provisions shall continue to perform, and new project will apply Decision 02.
 
On the other hand, in order to remove obstacles and to accelerate the progress of the project, Chairman Nguyen The Thao has requested the People’s Committees of Tay Ho, Cau Giay, Ba Dinh and Dong Da districts to strengthen propaganda and persuasion for households in clearance area to understand, agree and abide by the policy of land acquisition by the State. For those who intentionally failed to comply, the district’s People's Committee will apply administrative measures to ensure the correct order and procedures prescribed. The Steering Committee on site clearance of the city regularly inspects and supervises the progress of land acquisition projects, coordinates with other concerned departments and units for consideration and timely resolution of problems.
 
The Steering Committee also implements solutions to fulfill the task of land clearance. Specifically, it continues administrative reforms in a comprehensive and effective manner, prepares conditions for site clearance work towards proactiveness, promulgates policies promptly and in accordance with practice, promotes dissemination and training of land acquisition, promotes the certificate issuance of land use rights as the basis for site clearance compensation, resolutely handles violations of land legislation and management of urban construction, strengthens supervision of implementation of land acquisition policy, promptly removes difficulties and deals strictly with violations.
