Responsibility of ensuring occupational safety and health of labour hiring party to dispatched workers/labourers
1. Fulfil responsibilities and powers of the hiring party in occupational safety and health according to the law; not discriminate against dispatched employees, in comparison with its regular employees in respect of the working conditions.
2. Provide personal protective equipment in the workplace, provide regular health checks and diagnose occupational diseases for dispatched workers
3. Inform and guide dispatched workers to understand its internal regulations, dangerous elements, harmful factors and measures to ensure occupational safety and health in the workplace.
4. Provide occupational safety and health training for dispatched workers. In case dispatched workers have already been trained by the labour dispatch company, the hiring party will be responsible for providing additional training to meet new working conditions for such workers, as it has done for its regular workers
5. Upon the occurrence of occupational accidents or technical faults which may harm occupational safety and health of dispatched workers, the hiring party shall hold the responsibility to:
a) Provide timely first aid and emergency aid for sufferers;
b) Make reports according to the law;
c) Set up a grassroots occupational accident investigation panel to inspect accidents under its jurisdiction; cooperate with labour dispatch companies concerned to investigate occupational accidents; fulfil commitments stated in labour contacts and according to the law
6. Upon detection of dispatched workers suffering from occupational diseases, the hiring party must immediately and promptly notify labour dispatch companies concerned of the case and carry out procedures concerning occupational diseases for suffering workers as per commitments in labour contracts.
7. Make summary statements on occupational accidents and occupational diseases suffered by dispatched workers to labour dispatch companies concerned
8. Archive and provide copies of safety and occupational health-related records for labour dispatch companies
