Gov’t Tighten Construction Permission

The Vietnamese Government has issued the Decree 64/2012 on granting construction permits, featured by more closely defined regulations. Accordingly, construction works branded Level 1 or Special Level will be granted permits phase by phase at the discretion of investors. Unplanned construction will be granted at most two-phase construction permit, with the first concerning the construction of foundation and basement (if any) and the second covering the construction of body. If a project consists of many construction works, its investor may apply for construction permits for one or all works.
 
Detached houses with a total floor area of less than 250 square metres, with less than three floors and not in historically and culturally protected areas will be self-designed and the investors will be self-responsible for the safety of their houses and surrounding ones. Their constructions must match overall architectural development planning.
 
The decree also specifies three cases to be revoked construction permits, including: illegal granting of construction permits, no construction after six months of granting, and failure to correct wrongdoings in construction.
