Please let us about execution of contract with sub-contractor?

On 29 September 2006, The Government issued Decree No.112/2006/ND-CP (the "Decree") on amending and supplementing a number of articles of Decree No.16/2005/ND-CP dated 16 February 2006 on management of investment projects on construction of works. Accordingly, the Decree regulated execution of contract with sub-contractor as follows:

 

Subject to the scale, nature and requirements on timing for completing the project, the investor may sign contract with one or more contractors. The contractor may sign contract for performance of work with one or more sub-contractors provided that such execution must be approved by the investor as recorded in the contract signing with the investor and in conformity with laws on bidding. Thus, volume of work performed by sub-contractors shall be unlimited as former regulation in Decree No.16/2005/ND-CP. 

 

This Decree shall repeal regulations on pprinciples for selection of contractors in construction activities, general requirements applicable to dossier for tender invitation, dossier for tender participation, selection of architectural design for construction works, selection of construction consultancy contractors for construction works, selection of contractor for construction of works, selection of general contractor for design, procurement of materials and equipment and construction of works. Additionally, this Decree also amends the appendix on classification of investment projects of construction of work as stated in Decree No.16/2005/ND-CP
