Directive Resolution on Insurance Crime Prevention and Combat Issued

Guided by insurance laws, in the past five years, the Vietnam Social Security (VSS) and local social insurance agencies have actively coordinated with relevant agencies to prevent and handle crimes in social insurance, health insurance and unemployment insurance. However, acts of indebting, evading and defrauding social insurance, health insurance and unemployment insurance have been increasingly complicated.

Carrying out the action plan for enforcing Criminal Code 2015 and Resolution 41 of the National Assembly on the People's Court, to promptly prevent and combat insurance crimes and address hearing shortcomings and limitations, the Judge Council of the Supreme People's Court issued Resolution 05/2019/NQ-HDTP dated August 15, 2019 guiding the application of Article 214 on social insurance and unemployment insurance fraud crimes, Article 215 on health insurance fraud crimes, and Article 216 on evasion of social insurance, health insurance and unemployment insurance of laborers in the Criminal Code.

To disseminate information of the Resolution to judges and court officials and introduce the Resolution to supervisory agencies and people, the Supreme People’s Court announced Resolution 05/2019/NQ-HDTP dated August 15, 2016 guiding the application of Article 214 on social insurance and unemployment insurance fraud crimes, Article 215 on health insurance fraud crimes, and Article 216 on evasion of social insurance, health insurance and unemployment insurance of laborers in the Criminal Code. This resolution was adopted by the Judge Council of the Supreme People's Court on June 25, 2019 and scheduled to take effect from September 1, 2019.
