The Government of Vietnam issued Decree 37/2016/ND-CP dated May 15, 2016, which takes effect from July 1, 2016, provides detailed instructions for the enforcement of a number of articles of the Law on occupational safety and health with regard to compulsory insurance for occupational accidents and occupational diseases applicable to workers with employment contracts with employers; rights and responsibilities of agencies, units, organisations and individuals involved in the implementation of compulsory insurance policies for labour accidents and occupational diseases.
 
The rate of 1 per cent to social insurance pay fund of workers who work with indefinite labour contracts and with labour contracts with a term of three months or more and who work with labour contracts bearing a term of from one month to less than three months (excluding workers who are employed as homeworkers), paid business managers and executive managers of cooperatives.
 
Where the employer is an enterprise, a cooperative, an individual business household and a cooperation group active in agriculture, forestry, fisheries and salt production pay production-based wages or lump-sum wages every month, every three month or every six month.
 
The Government decided to reduce the above rates from January 1, 2018.
 
In addition, the employer is provided with occupational health and safety training according to the law on occupational safety and health with regard to insurance for occupational accidents and occupational diseases; and the employee is provided training in occupational safety and health when he/she pays insurance for occupational accidents and occupational diseases from 12 months upwards dated from the month of requesting support funds for occupational health and safety training.
 
The level of financial support for occupational health and safety training is calculated on the basis of the attendance of trainees, using the frame below:
- Not more than one time of base salary of a person for those in charge of occupational health and safety;
- Not more than a half of base salary of a person for those working with strict requirements on occupational health and safety;
- Not more than a quarter of base salary of a person for those administering occupational health and safety; health workers; and safety and hygiene staffs.
- A maximum support of 30 per cent of occupational health and safety fee.
