We learnt that the Government of Vietnam has just issued a Decree on issuing Certificate of residential house ownership and Certificate of construction work ownership, please let me know the main contents of this Decree
On 17 July 2005, the Government issued the Decree No. 95/2005/ND-CP on issuing Certificate of residential house ownership and Certificate of construction work ownership, the main contents of this Decree are as follows:
Applicable subjects: (i) Domestic organizations and individuals; (ii) Vietnamese overseas; (iii) Foreign organizations and individuals having residential houses, legitimate construction works in Vietnam.
Competent Authority: (i) Provincial People’s Committee shall issue Certificates to organizations; (ii) District-level People’s Committee shall issue Certificates to individuals.
Certificate shall be invalid in the following cases:
(i) Residential house, construction work are demolished or destroyed;
(ii) Residential house, construction work are seized or compulsory purchased by and under decision of competent authorities;
(iii) Residential house, construction works are located on lease land that lease term is expired but not permitted to be extended or not changed to land allocation for permanent use;
(iv) Residential house, construction works granted Certificates but subject to be retrieved by competent authorities for illegal issuance.
Conditions for issuance of Certificate:
(i) For individuals: being Vietnamese citizen, Vietnamese overseas or foreign individuals having legitimate residential houses, construction works in Vietnam;
(ii) For organizations: being organizations having juridical entity, establishing and operating under Vietnamese law, having legitimate residential houses, construction works in Vietnam.
Dossier for issuance of Certificate includes:
(i) For individuals:
- Application for issuance of Certificate;
- Copy of documents evidencing that the applicant is permitted to own or build residential houses, construction works in Vietnam;
- Drawings of residential house, construction works,
- Regular passport for Vietnamese overseas;
(ii) For organizations:
- Application for issuance of Certificate;
- Certificate of business registration or Approval or investment decision;
- Invoice for fulfillment of financial obligations.
