Decree on Land Law Realisation Positive for Locals and Companies

 

The Decree guiding the implementation of the Land Law will create more favourable conditions for individuals and companies, stressed the Minister for Resources and Environment Mai Ai Truc at a press conference to introduce some decrees and decisions related to land and sites for production and business, held on November 1, 2004 in Hanoi.

 

Apart from general regulations on entities to be applied or be responsible for the allotted land, the decree 182/2004/ND-CP lists organisations which are included in the system for land management and land use services. It specifies the content of land planning and land use as well as clauses related to the transfer of land use rights and purposes. The decree also provides conditions for the registration and granting of land use rights, even in the realty market. In the field of farming and non-farming land, it provides the limit on areas and period of usage.

 

The minister also introduced Decree 182/2004/ND-CP on administrative fines in land use and management, issued by the Government on October 29, 2004, and two decisions by the ministry on land use rights certificate and the issuance of the Land Law realisation plan.

 

The decree on administrative fines in land use and management provides specific fines for each level of violation, and at the same time specifies the responsibility of management bodies during inspections of land use and reclamation of misappropriated land.

 

The growing real estate market in Vietnam requires a more developed legal system. Deputy Minister for Resources and Environment Dang Hung Vo said the decree on Land Law realisation will have a significant impact on the local realty market, especially the transfer market, since it provides a more open environment for transactions in this market.

 

Along with the Land Law promulgated in 2003, these four decrees and decisions will help strengthen the role of the State with regard to land management and benefit local people and enterprises, Minister Truc asserted.
