Tax Procedural Violation Faces Fine of VND200 Million

On October 16, 2013, the Government issued the Decree No. 129/2013/ND-CP regulating sanctions of administrative violations in the domain of taxation and forcible execution of the decision on tax administration. Violators of tax administrative procedures may face the maximum fine of VND200 million. Fines on tax evasion, tax fraudulence and falsified declaration which make a decrease in payable value or an increase in refunded tax value are equal to 1-3 times of tax-evaded or defrauded value and 20 percent of tax amount short and tax amount refunded.
 
Wrong declaration cases include the act of wrong declaration that results in a decrease in tax payable or an increase in tax refundable, tax exempted or reduced; the act of using illegal invoices and bills to account goods and service value, etc.
 
According to the decree, individuals imposed sanctions for administrative tax violations may ask for fine exemption or reduction in case they are fraught with special difficulty like natural disasters, fires, accidents, epidemic and fatal disease.
